Brazilian Legal Services: How to Locate the Right Lawyer

Locating the right lawyer in Brazil requires a sequence of judgments: identifying the legal problem, finding practitioners whose work is relevant, verifying their professional status and assessing whether the proposed service meets the client’s needs. A recommendation may begin that process. It cannot establish, on its own, the candidate’s current authority, suitability or availability for a particular instruction.
For an international client, the assessment also concerns the connection between jurisdictions, the language in which advice will be delivered and responsibility for each part of the matter. The purpose of the enquiries below is to make those questions answerable before an engagement is accepted, without assuming that a prominent directory entry, an assurance of success or a familiar professional title supplies the missing evidence.
1. Understand the Relevant Brazilian Legal Framework
The Constitution establishes a federation with distinct legislative competences, including Union powers over civil, commercial, criminal, procedural and labour law, concurrent competences and matters of local interest. Articles 18, 22, 24 and 30 of the Constituição da República Federativa do Brasil de 1988 supply that framework. A candidate should be able to identify which rules and authorities bear on the problem rather than rely on a general description of “Brazilian law”.
Although legislation and codes are central to the civil-law framework, relevant judicial authority cannot be disregarded. Articles 926 and 927 of the Código de Processo Civil address coherent case law and the decisions that judges and courts must observe. Ask whether a proposed opinion takes account of the applicable precedents and how factual differences may affect their relevance.
Oral advocacy is not a feature unique to Brazil, nor does it mean that every case includes an unrestricted oral debate. Civil procedure regulates the opportunity to be heard, including its stated exceptions, in Articles 9 and 10, and identifies circumstances for oral submissions in Article 937. The useful question is which procedural opportunities exist in the contemplated case and what work the proposed representation includes.
2. Determine the Type of Legal Issue
Describe the facts and the decision that must be made before selecting a practice label. Civil, criminal, labour, tax and corporate law are broad starting points. Within them, experience in family disputes, contracts or a particular transaction may matter more than an undifferentiated statement that a lawyer handles litigation.
A cross-border element deserves its own analysis. Identify where the parties and relevant assets are located, whether another lawyer is already instructed and whether a proceeding or order exists abroad. The candidate should explain what can be addressed through Brazilian advice and which questions require a separately authorised professional elsewhere.
Separate the immediate task from the eventual objective. Reviewing a draft, responding to service, seeking urgent protection and taking a case through judgment are not interchangeable assignments. Presenting the immediate task clearly allows candidates to give a more useful account of their experience, conflicts and proposed scope.
3. Research and Verify Potential Lawyers
Professional Registration and Identity
The Cadastro Nacional dos Advogados is the official starting point for checking an individual’s registration. Compare the name, OAB number and section with the proposed engagement and communications. If a result or status is unclear, seek clarification from the relevant OAB section. Article 3 of Lei nº 8.906/1994 makes registration fundamental to the exercise of advocacy in Brazil; a diploma, business listing or website is a different form of information.
Consider who is communicating as well as whose registration number appears. An impersonator can reproduce another professional’s name. The OAB describes an identity-confirmation facility, ConfirmADV, through which registration details and an email address can be used to seek confirmation. Independent contact through an established channel is also a useful precaution. Failure to obtain an immediate confirmation is a reason to investigate further, not conclusive proof of fraud.
Foreign professional admission should be examined according to the work proposed. A person authorised under OAB Provimento nº 91/2000 as a consultant in foreign law has a restricted authorisation; that status does not permit Brazilian-law consultancy or court representation. Conversely, Brazilian admission does not establish permission to practise in the client’s home jurisdiction.
Recommendations, Directories and Consular Resources
A referral from a trusted colleague, relative or adviser may identify a practitioner worth considering. Establish why that person is being recommended: a comparable instruction, communication experience or a personal connection provide different information. None establishes a likely result in a new matter.
Commercial research resources include Best Lawyers, HG.org, The Legal 500, Latin Lawyer and Chambers. They can assist in discovering candidates, but their respective listing or assessment methods must be distinguished from OAB registration. A reference here does not establish that an individual appears in a particular edition or has received a particular distinction.
Consular information can offer another route to local contacts. The United Kingdom’s FCDO professional-services guidance links to its lawyer-finding service and expressly states that listed providers are not recommendations. The United States Embassy attorney-information address is another diplomatic resource to check for current availability. A consular list does not replace verification of Brazilian professional status or a client’s assessment of suitability.
Experience, Qualifications and Reputation
Ask for a description of relevant work, the role personally undertaken and any qualification on which the proposed service relies. A practice description, an academic title, membership of an association and demonstrated experience establish different things. OAB Provimento nº 205/2021 requires professional information to be truthful and regulates claims of specialisation; it does not turn an advertising description into independent proof.
Treat a claimed record of success with care. Outcomes depend on facts, evidence and procedural circumstances, while confidentiality limits what may properly be disclosed about former instructions. A reasoned explanation of relevant experience and the limits of comparison is more informative than an unqualified assertion that similar cases have been won.
Reviews may reveal questions to raise about communication, responsiveness or billing. They may also be incomplete, unverifiable or detached from the work now contemplated. A testimonial is neither a professional-status certificate nor a finding of misconduct. Distinguish a complaint from an established disciplinary determination; the Estatuto, including Article 70, identifies the OAB’s disciplinary framework.
4. Use the Consultation to Test Suitability
Confirm the consultation’s price, format and intended extent before booking it. There is no basis for assuming that most lawyers provide the first consultation free of charge. Ask whether the discussion includes document review, a written opinion or only an initial assessment, and whether a separate decision will be needed before any protective or procedural action is taken.
Provide an organised factual outline, the parties’ identities for conflict assessment and the documents most relevant to the immediate question. Identify adverse facts as well as favourable ones. This allows the candidate to explain what can presently be concluded, what remains uncertain and which additional records are necessary.
Evaluate the quality of the explanation. Does the lawyer distinguish allegations from evidence, identify the applicable route and discuss alternatives and risks? Article 9 of the Código de Ética e Disciplina requires clear information about the risks and consequences of a claim. A consultation that acknowledges limits can be more useful than one that supplies confident answers before examining the material.
5. Compare Cost, Scope and the Proposed Engagement
Price comparisons are meaningful only when the services being compared are defined. A fixed fee for a preliminary opinion cannot be assessed against an hourly proposal for litigation as if the two purchased the same work. Ask what is included, what triggers further remuneration, whether appeals or enforcement are covered and how the proposal treats negotiations or settlement.
The OAB Código de Ética e Disciplina, Articles 48–50, provides the framework for fee agreements. It recommends a written agreement, requires clarity about the object and extent of the work, addresses expenses and requires observance of the applicable section’s minimum fee table. These rules do not establish a single national price. A result-related arrangement must be assessed under the quota litis rules, including the limit concerning the combined fees and the client’s economic advantage; it should not be assumed to follow a foreign contingency-fee model.
Separate the professional fee from court charges, experts, translation and other third-party expenditure. Lei nº 8.906/1994, Articles 22 and 23, also distinguishes contracted fees from fees fixed or awarded judicially, including honorários de sucumbência. Ask how each relevant category is addressed rather than treating every payment associated with a proceeding as part of one quoted amount.
A written proposal should identify the client, the responsible lawyer and the assignment that will be accepted. It should also explain how instructions and significant developments will be communicated. The operational questions involved in concluding that arrangement are developed in How to Retain a Lawyer in Brazil.
6. Understand What the Lawyer Can Undertake
The lawyer’s professional function includes independent analysis and advice about lawful courses of action, together with representation within the agreed work and authority. It does not entail agreeing with every proposed tactic or predicting how another party, an expert or a court will act. Articles 9–11 of the Código de Ética e Disciplina link the relationship to risk disclosure, reciprocal trust and professional judgment.
Ask how the candidate would explain an adverse development, a need to revise strategy or a recommendation against litigation. A promise of a particular outcome or a guaranteed timetable is not a substitute for a legal assessment. The professional-publicity rules in OAB Provimento nº 205/2021 expressly restrict promises of results; a client should examine the reasoning and proposed work rather than seek a guarantee that counsel cannot supply.
7. Prepare for the Process and Organise Communication
A useful account of the contemplated process separates the next available step from the eventual conclusion. Ask which events are within counsel’s control, which depend on the court or other participants and what could change the assessment. General claims that Brazilian proceedings always take years or decades do not establish the duration of a particular case.
Maintain a coherent set of records: the documents supplied, versions of proposed instruments, important correspondence and the factual chronology. Tell the lawyer promptly about a new notice, hearing date or change in circumstances. Preserving the source and context of information is more useful than forwarding disconnected extracts without explanation.
Agree on the practical channel for questions, the person responsible for updates and the method for giving instructions on material decisions. This is a working arrangement to negotiate, not a universal office policy. Confidential material should be shared with attention to the lawyer’s duties under Articles 35–38 of the Código de Ética e Disciplina and to the actual participants who need it.
8. Evaluate Advice Through an Informed Professional Relationship
The decision to instruct counsel requires trust, but trust does not demand unexplained acquiescence. Ask for the reasons behind a recommendation, the alternatives considered and the consequences of declining it. The lawyer must preserve professional independence and explain the strategy; the client needs sufficient information to make the decisions that belong to the client.
If a material disagreement remains, address it directly rather than assuming that unquestioning compliance ensures a better outcome. Clarify whether the issue concerns evidence, the legal route, cost or a proposed act that the professional considers inappropriate. A sustainable instruction depends on an intelligible scope and reciprocal confidence, the relationship contemplated by Articles 10 and 11 of the Code.
Conclusion
The selection should rest on a verifiable professional identity, relevant experience and a proposal that makes the work understandable. Retain the evidence used to reach that assessment and resolve significant uncertainties before accepting the engagement. Frequently Asked Questions
What should I check before relying on a lawyer’s online profile?
Compare the individual’s name, OAB number and section with the official registration information and the identity of the person communicating. Then examine evidence relevant to the proposed work. A profile’s prominence does not establish either current professional status or suitability.
Does a directory ranking replace OAB verification?
No. A commercial directory and the OAB registration framework have different functions. A listing may help identify a candidate, while registration, experience and the proposed engagement require their own examination.
Are lawyers on a consular list recommended by the consulate?
A list must be read according to its stated terms. The FCDO expressly says that its listed providers are not recommendations. Consular information does not itself establish Brazilian professional authority or predict service quality.
Can I assume the first consultation will be free?
No. Confirm the proposed fee and what the consultation covers before booking. The price and extent of the initial discussion should be established with the professional concerned.
How can I assess experience without demanding confidential case files?
Ask about the nature of comparable work, the candidate’s personal responsibility and the legal or procedural issues encountered. The explanation must respect confidentiality and should identify the limits of comparing a former instruction with the present one.
Should I choose the proposal with the lowest quoted fee?
First establish whether the proposals cover the same services, stages and expenditure. An apparently lower amount may concern a narrower assignment. The comparison should account for scope, additional work, expenses and the applicable OAB framework, without assuming a guaranteed result.
